The General Data Protection Regulation (GDPR), approved in 2016 by the EU Parliament, is set to take effect May 25. This regulation will have a profound impact on the way businesses and other organizations collect, store, and use personal data—not only organizations based in the European Union, but those worldwide that offer goods or services to EU residents and monitor their behavior. Furthermore, the GDPR applies not only to “data controllers”—for example, a business that maintains records on its customers—but also to “data processors,” third parties that process data on behalf of data controllers.

Also known as EU Regulation 2016/679, the GDPR is a legal framework that restricts the collection and processing of personal information about EU residents. It sets forth principles regarding data management and privacy rights for individuals in the EU who are “data subjects.” The GDPR also guarantees such fundamental rights as the right to access personal data about oneself and the “right to be forgotten.” More information about the GDPR, including a link to the full text, can be found here.
What’s significant about the GDPR is its worldwide reach: Any organization that processes and maintains data pertaining to EU residents will be affected, regardless of its physical location. What’s more, the GDPR holds data processors and data controllers equally liable. This means you’re responsible if a noncompliant third party processes data on your behalf, and you might get hit with a substantial fine. Fines for serious violations can be as high as 20 million euros or 4 percent of your organization’s global revenue, whichever is higher.
